The Legal Bench respects your privacy and understands that recruitment data can be sensative. We comply with the General Data Protection Regulation (Algemene Verordening Gegevensbescherming “AVG”) and with the Recruitment Code (Gedragscode voor Weving en Selectie) of the Network for HR Professionals “NVP”. In this Privacy Policy you can read what kind of personal data we collect, and how we store, protect and use your personal data. Furthermore you can read for which purposes we will use your personal data and with whom your data will be shared.

 

What does this Privacy Policy apply to?

This Privacy Policy applies to your use of the website www.thelegalbench.nl and all the services that we offer you via this “Website”.

Personal data

In this Privacy Policy, your “personal data” means information or pieces of information on which basis you could be identified.

Which personal data do we process?

If you choose to register with The Legal Bench, we ask you to complete a registration form. In this context, you must provide us with your first and last name, address, zip code, place of residence, email address, phone number, current position, email address, which data we will process. We will further ask you to upload your resume which we store in our candidate file.

In addition, we will process data concerning the functions for which you may be eligible, your hourly rate, your desired salary and the information  provided regarding your personality and your career.

We may also process non-personal data whenever you interact with our Website. This data may include your browser name, the type of your computer and technical information about your means to connect to our Website (such as the operating system and the utilized internet service providers).

For what purposes do we use your personal data?

We may keep, use and share your personal data for legitimate business oriented purposes, including;

  • Providing services to you;
  • In the context of recruitment processes, amongst others to  assess your suitability for interim or permanent positions;
  • For maintaining our professional relationship; if you are a user of our Website, a client and/or a candidate;
  • To enable you to submit your CV for generic purposes and to be considered for interim or permanent positions;
  • To allow us to find interim or permanent positions suitable for you;
  • To comply with our (contractual) obligations towards our clients;
  • To provide personal data to a supervisory authority, a public body or a Court, to the extent we are legally obliged to do so; or
  • If you have provided your consent for specific purposes for which we may keep use and/or share your data.

On what basis does the Legal Bench process your personal data?

On the basis of the GDPR we may process your personal data for the following reasons:

  • Necessary for entering into or implementing an agreement – in order to fulfill our obligations to you and be able to provide the required service  we may need to process your personal data;
  • Necessary to comply to a legal obligation – we are subject to legal regulations which can obligate us to process your personal data. We can also be legally required to pass your personal data to a supervisor or to a supervising authority;
  • Necessary for our legitimate interests (or those of a third party),  to the extent our or such third parties interest outweighs your interest.

For which processes do we use your personal data?

Trusted third parties

We share your personal data and, if necessary, your sensitive personal data with trusted third parties we use to provide services you or our clients, for example:

  • Verification  the validity of job references;
  • Verification  qualifications; and/or
  • Verification of data you have provided with third parties.

We furthermore share your personal data with third parties whom on our behalf perform functions and services to us, like;

  • Professional advisors;
  • Suppliers of data analytics;
  • ICT-consultants who run tests and further improve our corporate technological systems; and/or
  • Research- and mailing companies.

We require that third parties with whom we cooperate commit to the minimum required rules  on confidentiality and data protection, take appropriate security measures and act in accordance with applicable laws an regulations.  In situations where data is being shared with third parties outside the EEA, we will make sure that comparable safeguards regarding confidentiality and data protection are in place.

Who has access to your personal data?

All personal data is stored in a secured database. Only  authorized personnel of the Legal Bench has access to such secured database in the context of the performance of their function.

With whom do we share your personal data?

We may share your personal data with clients with your specific consent, with a view   to possible interim or permanent positions.

How long we keep your personal data

Since we support candidates often for years, and potentially during the entirety of their career with the goal for which we keep your personal data is continuous. As a result we will store and keep your personal data for as lang as necessary for the proper performance of our services to you. We will update the personal data on a regular basis and outdated information will be deleted to make sure that (a) the personal data we keep is up to date and (b) we do not keep your personal data longer than necessary and shall remove your personal data from our databases upon your specific request.

Our framework agreements with clients specify that our clients can store and process  your personal data, e.g. CV’s, to the extent such personal data is received in the context of an application process for a specific permanent or interim position for which you are applying. Should a client store or process your personal data after completion of such process, you shall be informed about this.  and for a specific period thereafter

Your rights regarding personal data we store  

You got certain rights regarding your personal data we store. More specifically, you have the right to:

Right to Inspect

At all times you remain the right to request a copy of your personal data we store. However, if there is a valid reason and if in accordance with the GDPR, it, we can refuse your request to hand over a copy of (parts) your personal data. Whenever we refuse your request or part of your request, we will inform you about the  reasons for doing so.

Right of correction or supplementation

If the personal data we store is incorrect, outdated or incomplete, you have the right to correct, adjust or supplement your personal data. If you want to do so, please use the contact information given down below and inform us what you want to change.

Right to erase personal data

Under certain circumstances you have the right to request that the personal data we keep about you will be erased, for example when the information is no longer needed for the purposes for which such information has been  gathered and processed, or if the processing of the information is based on your consent, such consent is withdrawn and there is no other legal basis for the processing of your personal data by us.

Right of objection or limitation of processing

Under certain circumstances you have the right to object to or restrict the processing of your personal data. You will be able to do so with help of the contact information given below. This can be the case when, for example we process your personal data on the basis of our legitimate interest and there are no (mandatory) legitimate interests for the processing of your personal data by us which outweigh your rights and interests. You also have the right to object against the use of your personal data for direct marketing purposes.
